had just returned from war. bob redell joins us live in san jose with more. good morning, bob. >> reporter: good morning to you, laura. we have spoken with the father of allan devillena from here in san jose and he tells us and he thinks that his 22-year-old son would not have started a confrontation with police. he says he knew better. the family has already left their home here in san jose for palm springs where their son was shot and killed by police early saturday morning. it was two bicycle cops responding to loud voices in a parking garage in downtown. they recognized devillena from an earlier drunken public incident. when they ordered him and his passenger out of the car, the marine drove off. police fired their weapons, hitting and killing devillena. >> after we collect the witness statements, the statements from the officers involved and the evidence at the scene, we'll have a better determination of what actually occurred, what was occurring in the minds of the officers and what led them to use their weapons in this incident. >> reporter: devillena's friend was not h

when this is all over. you can see it is a spotty but action just traces and in san jose from this system but the weather about one-third of 1 in. and higher towards marin county. notice towards the north bay near windsor, there is that yellow showing moderate rainfall but for the most part it is right on its side. the batch of heavy rain fall with sausalito, richmond and alameda. as i mentioned, a it has been pretty dry in the south bay. the santa cruz mountains but not as much for the santa clara valley. this system for tonight and another weather system for tomorrow. we could receive at least 1 in. with higher near the rain/sonoma county and the santa cruz mountains. timing it out, coming up. >> the rainfall in the bay area means snowfall in the mountains this is video from squaw valley ski resort opened six days earlier than usual. hundreds of people took the advantage. north star into kirkwood ski resorts are also open. >> caviar king his facing several charges phillipe djegal will explain what happened. a 14 year old. he is facing 10 felony charges of assault, attempted

to break records there. a san jose could climb up to 83 degrees bridge and night record set in 1901. the full look at those numbers and when you need to pull out that umbrella coming up straight ahead. >> on the bay bridge is still a hot spot as you were to weigh in to san francisco. the start with a stall about an hour ago but the damage is done. the backup here has residual delays from the salt -- stall and is backed up to the 80 on 2580 westbound so give yourself extra time heading into center cisco. on the traffic that's he can see westbound 80 is crawling out of an old with the drive time from hercules the oakland is 34 minutes. it is still slow into the maze leading up to the bay bridge toll plaza so keep that in mind as you head into san francisco. traffic coming out of the north bay southbound 1 01 is crawling out of palo llama. there be a slow commute about 43 minutes from santa rosa and to nevada. by the time you reach the nevada side of one-on-one it picks up and moves well all the way up to the golden gate and than it is a good ride into san francisco. it is is crawling

in san jose nine in fremont this afternoon. fremont 69 with san jose most of us in the mid to upper 60s around the bay shore and inland 60s along the coast, low to mid 60s, significantly warmer than yesterday. mid 60s to 70 monterey bay inland 69 to 71°. tonight only a few 30s more 40s as this cold air mass continues to modify, 40s inland low 50s around the bay and to the coast. high pressure is starting to establish itself, pushed the storm track far enough north that is bringing in extra sun and modifying air mass this dip towards the left of the screen, that's our next system going to pull in as we head towards thursday into friday. for now one system well up to the north. if you are heading to the northernxy part of the state you are going to run into showers and mountain snows today. we have to wait a couple more days, warmer tomorrow, 70s from the coast, mid 60s, increasing clouds thursday, temperatures drop back four degrees, back a couple more friday with showers still have a small chance of showers saturday sunday is going to be the weather of the day this weekend, -- the wett

showing up about 70 degrees in concord. 70 in san francisco. and 72 in san jose. this is about as good as it gets though this week. we have some rain on the horizon. we'll talk more about that in a moment. right now let's check the roads with elizabeth. >> we are going to enjoy this dry commute while we can. we are following a couple of problems though. we are seeing in the usual amount of delays right -- an unusual amount of delays right now on westbound 4 because of an accident not even blocking lanes. it's off to the shoulder approaching a street lone tree way but unfortunately it's causing heavy traffic right now through antioch. also reports of an accident westbound 580 approaching santa rita, tassajara. we can't see it but we are seeing bunching up but we have delays stop and go from the altamont pass to the dublin interchange. the nimitz 880 through oakland near the oakland coliseum, no problems. 16 minutes between 238 and the maze. and a quick note for the south bay commute in san jose, they have closed off that off-ramp from southbound 880 to the alameda for emergency roadwork
